  • General

1.1         Unless otherwise agreed in writing by CMP, these general terms and conditions govern the use of this website and the purchase of products on it. By accepting to contract with CMP, the customer/consumer renounces overriding them by his own general terms and conditions.

1.2         Sale of goods through this web page is carried out by CMP sprl, a Belgian company registered with the B.C.E under the number 0874.994.141 and with registered office at 1170 Brussels, Avenue des Hannetons 32, bank account number BE32001459539802, telephone 0032476243371.

1.3         In accordance with the Belgian Code of Economic law, a consumer is a natural person who is acting for purposes who lies outside his professional activity.

1.4         The information of personal details that you provide CMP with shall be processed in accordance with the Data Protection Policies. When using this website, you agree to the processing of the information and details and you state that all information and details provided are true and accurate and you agree that report any change or modification thereto. CMP, as data controller, undertake to respect the confidentiality of your personal data and shall use personal data to manage your registration as a user of the website and to develop, compliance and undertake the purchase contract for the acquired goods. The duration of data procession shall either be for (a) the period set forth in laws; or (b) an indefinite period of time (for example until you request that your data be erased), or (c) for a certain period: data concerning your order will be processed as long as CMP will be required to hold such data under applicable laws, and will be erased once this lawful purpose ceases to exist. You may exercise your rights of information, access, rectification, erasure, blocking and objection by sending an e-mail to CMP at the following e-mail address maibelgium@gmail.com.

2    Formation of contract

2.1         With your order, you are placing an offer for a purchase contract with CMP. All orders are subject to the approval of CMP and only the explicit acceptance of the offer by CMP via e-mail, creates a legally binding contract.

2.2         To place an order through our online store, the online purchasing procedure must be followed. Firstly, the langue as well as the desired goods must be selected. Secondly, customer data, including billing address and delivery address must be entered. Thirdly, the payment method must be indicated. Fourthly, there is the option to check again and correct if necessary, all the information including the calculation method and the total price of the goods (VAT and delivery costs all in), before placing the order by clicking on “Order now with obligation to pay”. Lastly and in order to finalize the purchasing procedure, you must click on “Pay now”.

An order receipt with all order data will be sent to the e-mail address provided to CMP.

3      Delivery  

Delivery dates are intended as guideline only and CMP shall make every reasonable efforts to meet them but shall in no event be liable to the customer/consumer for delays resulting among others from force majeure as described in article 9 below.

  • Price – Payment
    • The price of het goods will be as stipulated at all times on the website.
    • All the prices are in Euros, including VAT (and packaging). No delivery fees will be charged for deliveries in Europe.  Delivery fees for deliveries outside Europe are added to the total price as indicated on the website.
    • The payment methods are the cards Visa, Mastercard, American Express and Paypall. While clicking “Pay now”, you confirm that the credit card is yours. Credit cards are subject to verification and authorization by the card issuing entity, but if the entity does not authorize the payment, CMP will not be liable for any delay or failure to deliver and CMP will be unable to formalize any contract with you.

When selecting the payment method, CMP will provide you the bank details in the order receipt. The invoice amount is to be paid within 5 days to the account of CMP.

  • Property Rights

5.1.        All copyrights, registered trademarks and other intellectual property rights to the materials or contents provided as part of the website belong to CMP.

5.2         The delivered goods remain the exclusive property of CMP until full payment of all claims.

The product risks shall be transferred to the customer/consumer from the moment of delivery.

6              Legal right of withdrawal

6.1         You have the right to withdraw from the purchase contract, within 14 days, without giving any reason.

The allocated cancelation timeframe is 14 days effective the day that you or an assigned third party acquire physical possession of the goods.

6.2         To administer your right of withdrawal, you have to inform CMP by sending an explicit declaration stating unequivocally that you are repealing your purchase contract (for example: by writing an e-mail at maibelgium@gmail.com or by sending us a letter in the mail or fax). You may use the cancellation template that is attached, but it is not obligatory.

It is sufficient for you to send us your notification of repeal within the given cancellation timeframe in order to meet the withdrawal deadline.

6.3         If you withdraw from the purchase contract, CMP shall reimburse to you all payments received from you, including het costs of delivery (excluding additional costs that result from choosing a different shipping/delivering option, other than the regular standard shipping option that CMP offers, without undue delay and within 14 days at most, effective the day CMP receives your repeal.

The payment method which was used to make the initial transaction, will also be used for the reimbursement, unless if you agree expressly to another method of payment. You will not be charged any fees for the reimbursement.

CMP reserves the right to withhold the reimbursement until CMP has received the returned items or until CMP has received your notification that you have returned the items, whichever comes first.

You must return the goods without undue delay and in any event no later than 14 days from the day you communicate your withdrawal from the purchase contract to CMP. The deadline is met if you send back the goods before the period of 14 days has expired. All return shipments are at your expense.

  1. Liability

7.1   The liability of CMP regarding the goods is limited to the price of purchase of said good or the replacement of the goods recognized as defective and no refund, compensation or damages may be claimed from CMP.

7.2         For damage caused to other property than the life, limb or health, liability is excluded if the damages were intentional or grossly negligent conduct of CMP and the behavior is no violation of material contractual obligations. Material contractual obligations are those obligations whose fulfillment the proper execution of the contract is made possible with and to which the consumer can and does expect in every case.

7.3   To the extent permitted by law, CMP excludes all guarantees, except those that may not be excluded legitimately in favour of consumers and users (including the legal guarantee of conformity as defined in articles 1649bis à 1649octies of the Belgian civil code).

All goods descriptions, information and materials shown on the website are provided ‘as is’ with no express or implied guarantees on the same, except those legally established. If you are contracting as a consumer or user, CMP is obliged to deliver goods that are in conformity with the purchase contract, being liable to you for any lack of conformity which exists at the time of delivery.

8                 Return of goods

8.1         In the cases in which you consider that the size of the goods that you have purchased is wrong for you, then you may request a change of size, without paying an additional delivery charge for the new goods being sent to you provided you return the original good to CMP.

The original goods must be returned to CMP in the same conditions as when they were delivered and including all the original packaging and instructions.

  • In case of damage or defect of the goods at the moment of delivery, you must contact CMP immediately and at the latest within 2 days after receipt of the goofs in question. After examining the goods, the refunding or replacement of the goods shall take place within 14 days from the receipt of the returned good. The costs of returning the goods due to damage or defect, will be reimbursed in full, including the initial delivery costs.

9         Force majeure

CMP shall not be held responsible or liable for the non-execution of its obligations, nor for the damage that may result from it, to the extent they are attributable to causes beyond the control of CMP.

10       Entire agreement

These conditions and any document referenced in the same constitute the entire agreement between CMP and the consumer and supersedes all prior agreements, negotiations, commitments, representations and undertakings of the two parties to the subject matter hereof.

11    Applicable law and jurisdiction

The use of this website and the product purchase contracts through this website shall be interpreted in accordance with and governed by Belgian legislation.

Any dispute arising or which may arise or is related to the use of this website or said contracts shall be treated exclusively by the jurisdiction of the courts and tribunals of Brussels, Belgium.
